Creator Terms

Eligibility and your account

To be a creator you must be at least 18 years old, or the age of majority where you live if that is higher, and you must be legally able to enter into this agreement and to produce and sell adult content where you live.

You sign up with your email, a password and a display name, verify your email and accept these terms. Keep your information accurate and up to date, keep your password secret, and tell us at support@myfans.site right away if you think someone else has used your account.

Your creator site

You get your own creator site on a subdomain of our domain. Before it goes live, you complete a checklist in the creator panel: site type (membership site, clip store or mixed), profile, categories, legal information, payout method, design and a minimum amount of content. Our moderation team then reviews the site, and it goes live only when approved.

You design your site: theme, colors, fonts, texts, images and sections. Purely visual changes, such as colors, fonts and the order of sections, are published right away; new texts and images are reviewed first.

You can link to your profiles on other platforms from our list of supported platforms. These links are published right away, and our moderation team can hide any of them. It can also hide wishlist items.

The footer, the legal pages and the “Report content” link of your site belong to the platform. You must not change, hide, cover or remove them, or make them harder to find.

The subdomain and the platform belong to us; your name, brand and content belong to you.

Discover

When your site is live, it appears on Discover, our directory of creator sites, with your site’s name and style, your profile photo and your categories, and a link to your site. Discover is only shown to visitors who confirm they are adults; your site’s name and style can also appear on the MyFans home page, without your photo.

You can remove your site from Discover at any time in your site settings. Our moderation team can also hide a site from Discover; we tell you by email, with the reason.

Verification of every performer

Every person who appears in your content, including you, is a “performer” and must be verified once before any content featuring them can be published. For each performer, you provide:

• Their legal name and any stage names.
• Their date of birth and country.
• A government photo ID (passport, national ID card or driver’s license), front and back when it has two sides, and its number.
• A selfie of the performer holding that ID.
• A signed 18 U.S.C. § 2257 form.

Our moderation team reviews each performer and approves or rejects them. Every performer must have been at least 18 when the content was produced.

You must tag each piece of content with all the approved performers who appear in it. Content that shows anyone who is not an approved performer, or who is not tagged, is not published or is taken down.

All information and documents must be true and complete and belong to the person they describe. False or borrowed documents lead to the closure of your site and may be reported to the authorities.

Records under 18 U.S.C. § 2257

For the content on creator sites, the platform keeps the records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 through its custodian of records:

As the producer of your content, you must also keep your own records for every performer as those laws require, and give us copies when we ask. See our 18 U.S.C. § 2257 Compliance Statement for more information.

Tell us right away if any performer information changes or turns out to be wrong.

Consent and releases

Before you upload any content, you must have the written consent of every performer in it to be recorded and to have the content published and sold on MyFans. Keep these consents and give us copies when we ask.

Consent must be given freely by adults who are able to give it. Content recorded or shared without consent is never allowed, as set out in the Acceptable Use Policy.

If a performer withdraws consent, or you learn of any problem with your content, tell us immediately at support@myfans.site. When a person tells us they appear in content without consent or have withdrawn it, we remove the content once we confirm they appear in it, and we keep it down while any dispute about consent is reviewed.

Content review and moderation

People on our moderation team review all content before it is published: videos, photo sets, stories, and the texts and images of your site. Stories disappear after 24 hours.

Under these terms and the Acceptable Use Policy, our moderation team can reject content, take down published content, hide a link or a wishlist item, suspend your site or close it permanently. Reports from others are handled as described in our Complaints and Content Removal Policy.

We email you every decision that affects you, with the reason, unless the law prevents us from doing so.

If you disagree with a decision, reply to the decision email or write to us at support@myfans.site and explain why. We review appeals and answer within a reasonable time.

Our review does not move responsibility for your content to us: you remain responsible for everything you publish.

Prices and limits

You set your prices in US dollars. A monthly membership must cost between $3 and $100 per month. You set the price of each single piece, and tips can be any amount within your site’s limits.

If you change your membership price, existing subscriptions keep the price they started with; the new price applies to new subscriptions.

Tips and gifts are voluntary and give fans nothing in return. You must not offer or promise anything in exchange for them, such as goods, services, contact, custom content or meetings. A gift is a payment toward an item on your wishlist: the money goes to your balance, and we do not buy, ship or deliver anything.

Revenue share and fees

You receive 80% of every sale on your site: memberships and their renewals, single pieces, tips and gifts. We keep 20% as our fee. The fee is calculated on the amount the fan pays, excluding any taxes added at checkout.

Each sale keeps the fee in force when it happened. We notify you of fee changes in advance, and they never apply to past sales.

If a sale is refunded or charged back, the sale and our fee are reversed in the same proportion and deducted from your balance. The chargeback fee charged by our payment service provider is also charged to your balance. If your balance becomes negative, it is offset against your next releases.

We handle fans’ refund requests under our Billing, Cancellation and Refund Policy.

Payouts

Your earnings from each calendar month are released on the 1st of the following month, in the platform’s time zone, and then paid to your payout method:

• International bank transfer (Wire or SEPA).
• ACH, for US bank accounts.
• USDT, on the TRC20 or ERC20 network.

You are responsible for keeping your payout details correct and up to date. Banks and networks may charge their own fees.

Payout holds

We may hold your payouts:

• While a report about your site is open, until it is resolved.
• While a chargeback or suspected fraud is being investigated.
• When the law requires it.

Once the reason for a hold is resolved, released earnings are paid under the normal rule, after deducting any refunds, chargebacks and fees.

Taxes

You are an independent business, not our employee, partner or agent. You are responsible for your own taxes on your earnings and for any registrations, filings and payments that apply to you. We may ask you for tax information.

Storage

Your site includes 100 GB of storage at no cost. Keep your own copies of your content: MyFans is not a backup service, and content that is deleted or taken down may not be recoverable.

The license you give us

You keep the copyright in your content. You give KF CC LLC a non-exclusive, worldwide, royalty-free license to host, store, process, display and stream your content to fans under your settings, only to operate the service. Processing includes, for example, transcoding videos and making thumbnails and previews as you configure them.

You also authorize us to give fans who pay for your content the personal viewing license described in the Terms of Service.

We do not use your content to advertise MyFans without your consent.

The license ends when you delete the content or your site is closed, except for copies we must keep for legal reasons, such as records, disputes or law enforcement requests, and backups kept for a limited time.

Your promises about content

For everything you upload or publish, you confirm that:

• You own it, or have all the rights and permissions needed to publish and sell it on MyFans.
• Every person in it is an approved performer, is tagged in it and was at least 18 when it was produced.
• You have the written consent of every performer to be recorded and to have it published and sold on MyFans.
• You keep the records required by 18 U.S.C. § 2257 and will give us copies when we ask.
• Its titles, descriptions, tags and previews match what it contains.
• It follows the Acceptable Use Policy and the law where it was produced and in the United States.

If a claim is brought against us because of your content or because you broke these terms, including a claim by a performer, the indemnity in the Terms of Service applies.

What creators must not do

In addition to following the Acceptable Use Policy, as a creator you must not:

• Offer, arrange or promote meetings, escorting or sexual services of any kind outside MyFans, including in exchange for tips, gifts or payments.
• Use previews, thumbnails, titles or descriptions that misrepresent what fans will get.
• Upload content you do not own or do not have the rights to, including content taken from other sites or creators.
• Open new accounts or sites to get around a decision of our moderation team.

Fan data

We handle fans’ personal data under our Privacy Policy. You never receive fans’ emails or payment details. For tips and gifts, you see the nickname the fan chose (or that they stayed anonymous), their message and the amount.

You must not try to identify, locate or contact fans outside MyFans, and you must not share or publish information about a fan.

Suspension and closure of your site

We may suspend your site or close it permanently if you or your content break these terms, the Terms of Service or the Acceptable Use Policy, if the law requires it, or to protect fans, performers or the platform.

While a site is suspended, it is not shown and its subscriptions stop renewing.

When a site is closed, its subscriptions stop renewing; fans keep access until the end of the period they already paid, although the site is no longer shown. Your remaining balance is paid out under the normal release rule, subject to holds, refunds and chargebacks. Identity documents and 2257 records are kept for as long as the law requires.

To close your site yourself, write to us at support@myfans.site. The same rules apply.

Ending this agreement

This agreement lasts until your site is closed. You can end it by asking us to close your site, and we can end it by closing your site as described above.

After it ends, the rules on your remaining balance, records, consent, your promises about content, the exceptions to the license, indemnity, liability and governing law continue to apply.

The disclaimers, limitation of liability, changes, governing law and general sections of the Terms of Service also apply to these terms. We notify you of material changes to these terms in advance, by email or on the site.
